Terms of Business
General
1: In the event of training being disrupted, suspended, extended or re-scheduled for reasons outside of the control of The Snowsports Company Kaprun a revised Agreement may be required.
2: Taxes on the all prices are included at the prevailing rate and applied to the taxable portions of the course. The Snowsports Company Kaprun will pass any future increases or decreases in Tax to the customer according to the applicable regulations.
3: The Snowsports Company Kaprun reserves the right to suspend training in the event of non-payment of fees.
4: The Snowsports Company Kaprun reserves the right to charge interest at the applicable rates for late payment.
5: Payments can be made by debit card, credit card or bank transfer. The Snowsports Company Kaprun does not accept payment by personal cheque or American Express. Payments must be paid in Euros and all estimated currency exchange rates within this website are correct as of time of publication.
6: All training payments made by credit / debit card incur a 2.99% administration charge, which is payable by the student (3.9% for non-EU cards).
7: Customers who elect to withdraw from training will not be entitled to any refunds and should refer to item 46 of The Snowsports Company Kaprun terms of business.
8: Customer information will not be released by The Snowsports Company Kaprun to a third party unless and except for specific business purposes.
9: The Snowsports Company Kaprun reserves the right, unless specifically requested otherwise, to include any pictures, images and other materials for publicity purposes involving customers enrolled for training.
10: The Snowsports Company Kaprun reserves the right to provide personal information to external security agencies where this might be considered necessary.
11: It is a condition of participation on The Snowsports Company Kaprun lessons that you maintain full insurance cover throughout the period of the tuition. This cover must be appropriate for the course and any other activity you partake in during the duration of the course. The Snowsports Company Kaprun has a Partner Agreement with World Nomads Insurance and ERV Insurance whereby ERV will offer 15% discount on premiums by using a discount code SIA15. Other Insurers are available to use.
12: The Snowsports Company Kaprun accepts no liability whatsoever if you suffer loss, death or personal injury where there has been no fault on the part of The Snowsports Company Kaprun or its employees, agents or suppliers and the loss, death or personal injury suffered is attributable to your own acts or omissions or to the acts or omissions of a third party not involved in providing the services which make up your tuition, or to unusual or unforeseeable circumstances or events which could not have been anticipated or avoided by The Snowsports Company Kaprun or its employees, agents or suppliers even with the exercise of all due care.
13: You are responsible for advising The Snowsports Company Kaprun of details of any medical condition or allergies that you have suffered prior to the commencement of the lesson and of any medication that you are on that may adversely impact on you whilst learning. In the event that SIA in its sole discretion considers that these conditions are likely to create an unreasonable burden on the efficient conduct of the lesson, The Snowsports Company Kaprun reserves the right to cancel your booking, in which event clause 39 is applied.
14: Travel to and from The Snowsports Company Kaprun lesson venues is your own responsibility (unless stated) and The Snowsports Company Kaprun cannot be held responsible for any cancellation, delay or booking problems with your travel arrangements.
Amendment and Cancelation by The Snowsports Company Kaprun
15: The Snowsports Company Kaprun makes every effort to operate its lessons as advertised but it may very occasionally be necessary to modify a lesson before its start date. If the modification is significant in that it substantially undermines the lesson for which you have contracted, The Snowsports Company Kaprun will notify you as soon as practicable and offer you three choices. You may (1) Accept the modification, (2) Change your booking to another available lesson or (3) Cancel and receive a full and prompt refund. If you choose another available lesson which is more expensive, you must pay the difference, however, if it is cheaper, The Snowsports Company Kaprun will make the appropriate refund. If there is a minor modification before you depart (that is a change not included in the definition of a significant modification set out above), The Snowsports Company Kaprun will try to notify you although it is not obliged to do so nor is it obliged to pay any compensation.
16: The Snowsports Company Kaprun reserves the right to lesson your course up to 14 days before the start date. However, it guarantees that it will not do so for any reason other than force majeure after the date on which the final payment is due or has been made, whichever is the later.
17: “Force majeure” meaning, unusual and unforeseeable circumstances beyond The Snowsports Company Kaprun’s control, the consequence of which neither The Snowsports Company Kaprun nor its suppliers could avoid, including, but not limited to, war, threat of war, riot, civil strife, terrorist activity, (actual or threatened), industrial dispute, technical problems with transport, machinery equipment, power failure, natural or nuclear disaster, fire, flood or other adverse weather conditions leading to a lack of snow, poor snow conditions or resort closure due to lack of snow. In the event of a cancellation due to force majeure, The Snowsports Company Kaprun will use reasonable endeavors to arrange an alternative lesson of a comparable standard. In the event of a cancellation due to force majeure, the company undertakes to give an appropriate refund having regard to the circumstances.
18: Ski Instructor Academy cannot be held responsible for ski lift operations of any given resort. It may be that during your course limited terrain is available due to circumstances and/or lift operation logistics. Customers accept that this is beyond the control of The Snowsports Company Kaprun when booking your lesson.
Amendment and Cancelation by Student
19: The Snowsports Company Kaprun will make every effort to assist you if you wish to alter any previously agreed arrangements. Requests must be made in writing by email. A charge per amendment of €25, together with all communication charges or other expenses incurred by The Snowsports Company Kaprun, will be made. These charges will be payable whether or not The Snowsports Company Kaprun succeeds in confirming your requested amendment. Depending on the conditions imposed by our suppliers, an amendment request may have to be treated as a cancellation and re-booking which may be subject to further charges.
20: All cancellations must be advised in writing by email. Any written cancellation notices should be sent to The Snowsports Company Kaprun by email or post (recorded delivery must be used). Cancellations are effective on the day they are received by The Snowsports Company Kaprun.
21: Should a customer cancel their lesson 60 days or more before the start date you will receive a refund of 50% of the total costs minus deposits and administration costs.
22: Any cancellation made within 60 days of the commencement date of a lesson is subject to loss of deposit and The Snowsports Company Kaprun reserves the right to withhold all payments received to date. The Snowsports Company Kaprun may, under certain circumstances return a percentage of the fee paid by you, however such circumstances are at the discretion of The Snowsports Company Kaprun.
23: Deposits are non-refundable and can not be transferred to any other person.
24: If you are unhappy with any aspect of The Snowsports Company Kaprun’s arrangements during your lesson, you must address your complaint immediately to a senior representative who will attempt to resolve your issue.
25: If the problem cannot be resolved locally and you wish to complain, full details must be sent to The Snowsports Company Kaprun’s Head Office in Austria by email or in writing and must arrive within 14 days of the problem arising. Failure to take either of these steps may deny The Snowsports Company Kaprun the opportunity to resolve the problem immediately and/or investigate it properly. In consequence, this may affect your rights under your contract with The Snowsports Company Kaprun.
Purchases And Orders By The Snowsports Company Kaprun.
26: All purchases, orders and services made by The Snowsports Company Kaprun are subject to our terms and conditions. Companies agree to the following when accepting any payment or order made by The Snowsports Company Kaprun.
27: All orders and purchases made that exceed a total price of €2500.00 must be authorised and underwritten in the form of an official Snowsports Company Kaprun Purchase Order by 2 company directors. Any orders under this value can be authorised by one director.
28: A confirmation of an order for services or purchases together with your terms and conditions must be made in writing by Email to info@snowsportskaprun.com or by recorded delivery to the head office: The Snowsports Company Kaprun, Kleinsonnberg 52, 5660 Taxenbach, Salzburg, Austria. A confirmation email will be returned once this is received. No orders can be accepted without this confirmation from The Snowsports Company Kaprun.
29: The Snowsports Company Kaprun reserves the right to cancel any purchase or order that does not have a valid purchase order or is in breach of the above terms and conditions.
